Please read these Terms & Conditions ("Agreement") carefully before booking any services from Frame and Focus, LLC ("we," "us," or "our"). This Agreement sets forth the legally binding terms and conditions for your use of our photo booth rental services.

By booking our services or making a payment, you ("Client," "you," or "your") agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not proceed with a booking or use our services.

1. Services Provided

Frame and Focus, LLC agrees to provide photo booth rental services as detailed in the Client's invoice and selected package. This includes the delivery, setup, operation, and breakdown of one (1) photo booth unit, along with selected props, backdrops, and an on-site attendant (if included in the package), for the event specified in your booking confirmation.

2. Booking and Payment

2.1 Payment Due Date

The full balance for your chosen package and any confirmed add-ons is due upon purchaseto your Event Date. All payment must be completed before the scheduled start of photo booth operation.

2.2 Payment Methods

Payments can be made via Zelle, Cash App, Venmo, or other electronic methods accepted by Frame and Focus, LLC. Specific payment details will be provided upon booking confirmation.

2.3 Additional Charges

Any additional hours or add-ons requested on-site are subject to availability and will be charged at our current rates, payable immediately at the time of the request.

3. Cancellation and Rescheduling Policy

3.1 Client Cancellation

• Cancellations made 14 days or more prior to the Event Date will not incur a cancellation fee.
• Cancellations made less than 14 days prior to the Event Date may require payment of the full rental fee if services or staff have already been irrevocably committed to the event.

3.2 Rescheduling

Requests to reschedule an event are subject to our availability. A rescheduling fee of $50 may apply if the request is made less than 7 days prior to the original Event Date.

3.3 Provider Cancellation

In the unlikely event we must cancel due to unforeseen circumstances (e.g., equipment malfunction, serious emergency, force majeure event), we will work with you to reschedule. If rescheduling is not possible, a full refund will be issuedif payment was made in advance.

4. Event Details and Venue Requirements

4.1 Event Details

The Client is responsible for providing accurate event details, including the date, time, venue name, address, and primary contact information. Any changes must be communicated to Frame and Focus, LLC promptly and in writing.

4.2 Space and Power

The Client agrees to provide a minimum 10x10 foot space for the photo booth setup and clear access to a standard 120V electrical outlet within 10 feet of the designated setup area.

4.3 Shelter for Outdoor Events

For outdoor setups, adequate shading (e.g., a sturdy tent or fully covered area) is required to protect equipment from direct sunlight, rain, wind, or other elements. If suitable shelter is not provided upon our arrival, a $100 Outdoor Shading Fee will be automatically applied to the final balance. If, in our sole discretion, unsafe conditions (e.g., extreme heat, heavy rain, high winds without proper shelter) are present, we reserve the right to cancel service without refund to ensure the safety of our equipment and staff.

4.4 Venue Permissions

The Client is responsible for ensuring the venue allows photo booth services and for securing all necessary permits, fees, or permissions required by the venue.

4.5 Parking

The Client agrees to provide convenient parking at the venue for our vehicle during setup, operation, and breakdown.

4.6 Travel Fee

A travel fee of $50 will apply to events located beyond a 50-mile radius from our business address at 11 Laughton Street, Upper Marlboro, MD 20772.

5. Photo Booth Operation

5.1 Setup and Breakdown

Our attendant will arrive approximately 30 minutes before your scheduled event start time to set up the photo booth. Breakdown will occur immediately after your rental period ends.

5.2 Operational Time

The photo booth will operate for the duration specified in your selected package. Any attendant breaks (applicable only if an attendant is purchased as part of your package) will not count against the rental time.

5.3 Attendant Role

If an attendant is included in your package, our friendly attendant will manage the booth, assist guests with props and poses, and troubleshoot any issues to ensure a seamless experience. If an attendant is not included, the booth will be self-service.

6. Client Responsibilities & Damage

6.1 Guest Conduct

The Client must ensure guests use the photo booth and props safely and respectfully.

6.2 Damages

The Client is liable for any damage to our equipment caused by themselves or their guests due to misuse, negligence, or willful misconduct. Repair or replacement costs for such damages will be billed directly to the Client.

7. Photo Usage Waiver

Client grants Frame and Focus, LLC irrevocable permission to use photographs and images taken at the event for marketing and promotional purposes. This includes, but is not limited to, display on our website, social media channels, and other marketing materials.

Opt-Out: Clients wishing to opt out of this photo usage must notify us in writing prior to the event. Guests who do not wish to appear in promotional content should refrain from using the photo booth.

8. Indemnification

Client agrees to indemnify and hold harmless Frame and Focus, LLC and its staff from any claims, damages, losses, or liabilities arising from the Client's or guests' use of the photo booth, except in cases of gross negligence or willful misconduct by Frame and Focus, LLC.

9. Force Majeure

We are not liable for any delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, or other emergencies. In such an event, we will work diligently with you to reschedule or find a mutually agreeable solution. 

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Maryland. 

11. Entire Agreement

This document, along with your invoice and selected package details, constitutes the entire agreement between the Client and Frame and Focus, LLC, superseding all prior and contemporaneous communications, understandings, and agreements.
